Defence continues in theft case

The theft case involving Badou Sey, Modou Njie and others accused of burglary and stealing, continued recently at the Kanifing Magistrates’ Court with the defence testimony of the second accused, Modou Njie.

The second accused told the court that on the day of the incident, at around 6:30am, he went to the Banjul garage to board a vehicle to go to the hospital for medication.

He went up to a junction and found a flat screen computer and a laptop, he said, adding that he looked around and could not see anybody; then he picked the flat screen and the laptop, kept them at a safe place and then proceeded to Banjul for his treatment.

He further testified that when he returned from the hospital, he met some people who asked him if he was the one who took the items, it would have been better for him to return them to the owner, because the missing items had resulted to problems.

 He added that he then handed over the items to the owner.

He asserted that while he was sitting with the shop owner, the shop owner left him and later came back with a police officer who then arrested him and took him to the police station.

He gave his statement at the station and was later charged and detained with the other accused persons.

Under cross-examination, when asked where he found the items, he said he found them at a junction.

When it was put to him that he broke into the shop and stole the items and that even the first accused stated in his testimony that it was him (Modou Njie), who broke into the shop and invited him to come and steal. He replied in the negative.

When it was further put to him that despite his sickness, he was able to carry the said items, he replied that he did not take them.

At that juncture, his cautionary statement was tendered and admitted as exhibit.

The case continues.
