The
Gambia Court of Appeal, presided over by Justice Awa Bah, Justice Jacob A.
Dada, and Justice Orifowomo, yesterday struck out the criminal appeal case
involving the December 30th attackers.
When
the case was called, S. Kennedy represented the appellants and the respondents
were represented by O. Danso and E.R Dougan.
The
appellants were absent, but S. Kennedy informed the court that they have filed
a notice of abandonment in accordance with rule 5 of the Gambian Court of
Appeal Act on 17 March 2017, in respect of all the appellants.
Justice
Awa Bah said Kennedy did not enter appearance for all the appellants, but
Kennedy replied that the appellants appended their signature on the notice of
abandonment.
He, therefore, urged the court to strike out
the appeal.
O.
Danso, in her response, raised no objection to the appellants’ counsel
application.
The
appeal court subsequently struck out the appeal, pursuant to the notice of
abandonment under rule 5 of the Court of Appeal Act.
