In proving their claim, the representative of the plaintiff Tombong Gibba told the court that the defendant Isatou Saidy rented in the plaintiff's office and never paid the rent amounting to D100,000. The witness further stated that the plaintiff had verbally warned the defendant to pay the rent. She revealed that the defendant promised to settle the rent but failed to do so. She added that the plaintiff instructed their counsel to write to the defendant to effect payment but to no avail.
Magistrate Wadda-Ceesay subsequently told the court in her judgement that the plaintiff had proved its claim on the balance of probability and therefore ordered the defendant to pay D100,000 to the plaintiff with D2000 cost and 4% interest. A 14-day eviction ultimatum was also given to the defendant.
