Magistrate M.L.K. Bojang of the Brikama Magistrates' Court recently convicted and sentenced one Omar Ceesay to a fine of D4, 000, in default to serve four months in prison for discharging waste water into the public highway.
In delivering his judgement, Magistrate M.L.K. Bojang told the court that when the charge was read to the accused he pleaded not guilty.
He said the prosecution had called in one witness to testify, who in his testimony stated that he found the accused digging drainage from his compound to the public highway, where wastes water could pass through.
Magistrate Bojang further stated that the convict in his testimony agreed to have dug a passage at the back of his fence, but did not call any witness in support of his defence.
He said the court later moved to the location and found a new passage at the back of the convict's fence.
Consequent upon this, he said the prosecution has proven its case beyond all reasonable doubt.
