The accused, Modou Joof, was charged with the offence of stealing a mobile phone valued at D700 and cash of D240, from the shop of one Alasanna Bah.
Joof, in his defence, told the court that on the day in question, he was going to work and did enter the shop of the complainant with the intention of buying a cigarette, but then he found the complainant sleeping.
He knocked at the counter and when the complainant woke up, he said he saw him behind the counter.
“The complainant asked me what I wanted and I told him I wanted a cigarette but the complainant said I was lying, and that was not true, saying I am a thief,” he explained.
The complainant then managed to close the main door opposite the highway and left him inside the house, went outside of the shop and started shouting thief, the accused narrated, saying the neighbours came out in their large numbers and started beating him seriously.
He added that he was later dragged to the police station where they told the police that the said items were found in his possession, which he said was not true, because the items were taken to the police station by the complainant.
The case continues.
