At the heart of this noble pursuit stands a group of individuals whose dedication, wisdom, and hard work have shaped the very fabric of the legal system in The Gambia - the Senior Counsel of the Gambia Bar Association. These men and women, who have spent decades traversing the corridors of the Courts, shaping legal practice, and offering counsel to younger generations, deserve our deepest respect and gratitude. In recognising their invaluable contributions, we not only honour their legacy but also reaffirm our commitment to preserving the values they fought to instil in the legal profession. This article is a tribute to them, a celebration of their sacrifice, and an acknowledgment and appreciation of the crucial role they have played in shaping the legal landscape of The Gambia.
To understand the significance of Senior Lawyers in The Gambia, one must first recognise what it means to be a Senior Counsel. This title is not merely an honorary designation, it is a reflection of years of dedication, sacrifice, and unparalleled expertise in the legal field. Senior Counsel have long been the stewards of legal practice, the guardians of ethics, and the paragons of professional excellence. For many of these lawyers, the journey to becoming Senior Counsel was long and arduous, requiring immense personal sacrifice and a lifelong commitment to the legal profession. They did not enter the legal field seeking fame or wealth, but out of a genuine love for justice and a desire to contribute to society in meaningful ways.
Over the years, they have played pivotal roles in landmark legal decisions, guided the development of Gambian jurisprudence, and mentored countless young lawyers including myself who have followed in their footsteps. The history of the Gambian legal system cannot be written without acknowledging the pivotal role that Senior Counsel have played in its development. From the days when the Old Courthouse on Wellington Street served as the centre of legal proceedings, to the modern facilities on Independence Drive, these lawyers have witnessed the evolution of the system and helped steer it through times of change. They were present during some of the most significant moments in our country’s legal history, times of political upheaval, the 1981 bloody coup, the 22 year of authoritarian rule, legal reforms, and social transformation. Through all of this, the Senior Counsel have remained unparalleled in their commitment to the law, ensuring that justice was served in the face of adversity. Their sacrifices extended far beyond the courtroom, they have been pillars of support for the legal fraternity, always willing to offer advice, mentorship, and guidance. What distinguishes these Senior Counselfrom other practitioners is their unflinching commitment to the principles of justice, fairness and ethics. Their work was never just about winning cases or earning fees, it was about ensuring that the law was applied equitably, and that those who sought justice could rely on the integrity of the system. They dedicated their careers to making sure that the legal profession remained true to its foundational values. This commitment was particularly evident in the days when the old Courthouse on Wellington Street served as the heart oflegal proceedings in country. The building, though not as grand as the new Court House on Independence Drive, was a symbol of the resilience and determination of those who practiced within its walls. For many Senior Counsel, it was here that they began their careers, working long hours and facing daunting challenges, all for the sake of justice. The move from the old Courthouse on Wellington Street to the new Court House on Independence Drive marked a significant shift in the legal landscape of The Gambia. While the new facilities offered modern amenities, they also signified a new era for the Gambian legal profession. This transition, however, was not without its challenges. As the profession evolved, so too did the expectations place on legal practitioners. For Senior Counsel, this meant adapting to changing legal frameworks, new technologies, and shifting societal expectations. Despite these changes, however, they continued to lead by example, demonstrating the importance of professionalism, integrity, and ethical conduct. Their resilience in the face of change serves as a powerful reminder of the importance of maintaining one’s commitment to the law, even as the world around us transforms.
Perhaps one of the most enduring legacies of the Senior Counsel is their role as mentors. For many young lawyers, these seasoned professionals have been both role models and teachers. They have offered invaluable guidance, not only on legal matters but on how to steer the complexities of the profession with integrity and honour. In a world where the pressures of financial success often overshadow the pursuit of justice, the guidance of Senior Counsel has been instrumental in reminding young lawyers of the true purpose of their profession. They have taught us that law is not merely a means to an end, but a lifelong commitment to upholding the values of fairness, equity, and justice. As the practice of law has become increasingly commercialised, with many lawyers treating it as a business venture rather than a noble calling, the role of the Senior Counsel has become even more vital. They have watched as the pressures of modern life and the pursuit of financial gain have led some younger lawyers to lose sight of the ideals that once guided the profession. The rise of corporate law firms, the increasing specialisation of legal practice, and the commercialisation of legal services have all had a profound impact on the profession. In this context, the Senior Counsel have remained steadfast in their commitment to the core values of law, reminding us that our work is not just about profit, but about serving the public good.
It is also vital that we pause to honour and remember those Senior Counsel who are no longer with us. These individuals, who have shaped the Gambian legal system with their wisdom and dedication, are deeply missed. They gave their lives to the law, contributing tirelessly to the growth and integrity of the profession. Their legacy lives on through their work, their teachings, and their enduring influence on the generations of lawyers who followed them. As we remember them, we are reminded of the inevitable nature of death, a truth that underscores how vulnerable we all are. Time, which has allowed us to celebrate their accomplishments, also has the power to take them from us. In this fleeting moment of life, we must never forget that every moment counts, and we must honour the contributions of those who came before us while we still have the opportunity. The passing of these Senior Counsel serves as a reminder to cherish the time we have, and to live our lives with the same dedication to service, integrity, and justice that they did.
To the young lawyers who follow in the footsteps of these giants, I urge you to always show respect and appreciation for the Senior Counsel. Their wisdom is not just academic, but practical, their guidance is invaluable, and their example, one that should be emulated. The road they have travelled was not easy, and it is through their sacrifices that many of us have been able to build our careers today. Too often, we become preoccupied with our own success and forget to acknowledge those who paved the way for us. Respect for our Senior Counsel is not just a courtesy, but a professional obligation. They have given much to the profession, and it is our duty to uphold the standards they have set, to continue their legacy, and to ensure that the integrity of the law remains intact.
Let us remember that we are part of a tradition that spans generations, and that with success comes the responsibility to honour those who have come before us. It is also important that the Executive of The Gambia Bar Association recognise and honour the contributions of these Senior Counsel. A more formal system for celebrating their achievements and dedication to the legal profession should be established. I call for the institution of a special day dedicated to celebrating these giants, perhaps in conjunction with the legal year celebrations. This day could be an opportunity to reflect on their contributions, offer awards for outstanding service, and give recognition to those who have shaped the law in The Gambia. Moreover, the Executive of the Gambia Bar Association should actively seek the counsel and guidance of these Senior Counsel in all matters that affect the future of the profession. Their experience is an invaluable resource that should not be ignored. They have lived through the changes in the legal system and have much wisdom to offer on how to preserve and enhance the integrity of the profession.
The legacy of Senior Lawyers is one of sacrifice, service, and unyielding dedication to justice. They have built the foundations of our legal system, mentored generations of lawyers, and ensured that the law remains a tool for fairness and equality. Their contributions are immeasurable, and their impact on the legal profession in The Gambia will be felt for generations to come. As we honour their legacy, it is important that we do not just remember them in words, but also in deeds. We must ensure that the legal profession remains true to its noble purpose, that it serves the people, and that it continues to uphold the rule of law with integrity and commitment.
To the Senior Counsel of The Gambia Bar Association, we owe you a debt of gratitude that cannot be expressed in words. Your hard work, dedication, and unyielding commitment to the law have laid the foundation for the future of our legal system.
