According to the verdict, Madam Cham was convicted to pay a fine of D10,000 in default to serve 2-years imprisonment and to pay a compensation of D300,000 in default to serve 2-years imprisonment.
Immediately after the judgment, the family of the victim/convict paid the amount of D10,000 to lessen her sentence of serving 2 years in prison.
According to the statement of offence, Cham, sometime in the year 2020, at in the Kanifing Municipality of the Republic of the Gambia, stole three hundred thousand dalasis (D300,000.00) being the money of one Alagie Bittaye given to her for safekeeping, thereby committed an offence.
The defendant, Bittaye, was an apprentice at the time of giving the money to the victim. He said he was saving the money to buy a vehicle for himself.
According to the Criminal Code Caps 10.01 Vol. III laws of the Gambia 2009, section 252 states that “any person who steals anything capable of being stolen is guilty of the felony termed theft and is liable unless owing to the circumstances of the theft or the nature of the thing stolen, some other punishment is provided, to imprisonment for five years.
Cham has now been imprisoned in the lawful prison at Mile II with hard labour.
