The witness Alfusainey Dari testified before Justice E. Jaiteh of the Banjul High Court saying he was a driver at the Diouloulou Garage in Cassamance where the accused Ousainou Bojang went to board a vehicle to Zinguinchor.
Defence counsel L.J. Darboe told the witness that other than the fact that the accused went to Diouloulou, all he said was a fabrication. But the witness responded that all what he had said at court was what he saw and heard.
Counsel Darboe put it to the witness that Ousainou did not tell him anything other than about a marabout who would fix his (the accused’s) relationship with his white lady.
The witness further testified that he did not know Mama Jabbi, the marabout lady who was the 3rd prosecution witness, but the defence counsel put it to him that he knew Mama Jabbi because he directed Ousainou Bojang to her as marabout.
However, the witness denied knowing Mama Jabbi but confirmed knowing the landlady where Mama Jabbi was residing.
Counsel L.J. Darboe read a part of the witness statement where he indicated that he knew Mama. But the witness said what counsel Darboe read was not what he told the police, adding that the defence counsel might have been the one who wrote that statement.
Counsel L.J. Darboe further read the witness’s statement to him where he said he boarded a motorcycle to where Mama Jabbi was staying.
The witness Alfusainey Dari confirmed that was correct because he boarded a motorcycle to where the fortune teller was residing.
The witness also stated in his testimony that Mama Jabbi did not tell him to call the gendarmerie. But the defence counsel read that the witness initially stated in his statement that Mama Jabbi had asked him to notify the gendarmerie.
PW13 also said it was the landlady who told him he should notify the military but he said he was going to notify the gendarmerie.
