Binga D. made this statement yesterday at the court.
The plaintiffs have filed a suit against Maiden Pharmaceuticals, Atlantic Pharmaceutical, Medical Controls Agency, Ministry of Health and Attorney General following the consumption of a cough syrup manufactured by Maiden Pharmaceuticals leading to the deaths of several children.
Binga D., who represented the state together with E.R. Dunga, said the office of the Attorney General was facilitating the settlement of the case out of court with the plaintiffs’ counsel.
Counsel Yassin Senghore, who appeared for the plaintiffs, confirmed that the defence counsel had approached them for the matter to be settled out of court, and they had agreed with the state counsel for the matter to be adjourned until 15 December 2023.
It would be recalled that Justice Jaiteh recommended in court that the state amicably settle the matter between the plaintiffs out of court, adding that the state has a mandate and right to protect her people and property.
However, the court asked the plaintiffs’ counsel to know how far they have gone with the order of the court that the plaintiffs publish their writ of summons in India because they could not locate the 1st and 2nd defendants.
Counsel Y. Senghore responded that the process had been forwarded to the lawyer in India but there was a slight delay in the process of publishing the first and second respondent publications in the India Times Newspaper due to the “Diwali” celebration in India.
She further said they received a message yesterday morning from their contact(s) in India that they would get back to them before the end of the week.
The case was adjourned until 15 December 2023.
