When the prosecution witness Lamin Y.A. Sanneh was questioned about the arrest of the alleged drug dealers - Paulo Djabi and Nadine Pereira, first and second accused, respectively, he said they were arrested at Envy Night Club but he did not know whether they were arrested in or outside of the club because he was not present at the time of the arrest.
The witness further stated that the Joint Investigation Team set to investigate the alleged drug dealers were not issued with any gun or baton at the time of the arrest.
Defence counsel put it to the witness that the officers who went to arrest the accused threatened to shoot them if they moved, but the witness said he was not at the point of the arrest and could not tell what happened there.
Counsel Tambadou further put it to the witness that at the point of the arrest of the accused, an officer said to the hearing of the first and second accused in English that, “If they move, shoot to kill”. But the witness said he would not know as he was not present during the arrest.
He further said the first and second accused did not carry any weapon at the time of the arrest because they were brought to the Drug Law Enforcement Agency office with no weapons.
Counsel Tambadou asked the witness - as experienced DLEAG officer, whether a person arrested with 1.6 grams of MDMA is likely to have it for personal consumption or dealing? It could be used for both, the witness responded.
The prosecution witness further narrated that he visited the house and inspected the room occupied by the first and second accused and found drugs therein.
Subsequently, the witness said a drug was also found in the house of the 3rd accused Mamadu Neto Djabi in Baraka Estate, adding that the 3rd accused led them to that house.
Asked which room in the house was the substance found, the witness said somewhere in the house between the sitting room and the kitchen. He also told the court he did not find anything with the 3rd accused when he searched him. But they went to his house and found the alleged substance.
Defence Counsel Tambadou again put it to the witness that the 3rd accused was administered an electric shock, put in handcuffs and beaten at the Kairaba Police Station, but the witness, Lamin YA Sanneh, said he was not aware of any beating of the 3rd accused.
“I further put it to you that the 3rd accused had his pants removed and was beaten on his testosterone,” Tambadou argued but the witness said he was never aware of any beating.
”I’m putting it to you that DLEAG administered an electric shock on the 3rd accused person at the Kairaba Police Station,” the defence counsel persisted. “Not to my knowledge,” the witness responded.
The case was adjourned until December 2, 2024.
