The accused was charged with single count of rape. When the case was called on 4 April 2024, the witness told the court that sometime in January 2019, he observed that his daughter was walking abnormally and he questioned her but she refused to say anything.
The defence lawyer, counsel O. Susso, questioned the witness in the last proceedings on Tuesday, on when did he the witness observe his daughter was walking abnormally. Within 2 days the accused raped his daughter, the witness answered, saying: “That was when I called my daughter and she told me that the old man did it to her.”
He further stated that when he observed his daughter on the first day and confronted her, the daughter denied, but on the second day, he said the daughter told him what happened and that was when he sent someone to call the accused for him.
He testified that after observing his daughter, he then called the mother and told her that considering the way he saw their daughter, it seemed someone had had sexual intercourse with her but the witness said the mother denied his consideration or perception.
Case was adjourned until 8 May 2024.
