Court asks surety to pay half of bail bond

Magistrate Dun Njie of the Kanifing Magistrates’ Court yesterday asked a surety for an accused person to pay half of D29,500 since the person she stood surety for had failed to appear in court on several occasions.  The presiding magistrate told the court that the surety had signed a bail bond so that if the accused person absconds, she would forfeit the bail sum to the state. “This is trite law,” she posited.

She went on to state that the surety did not make any effort to make sure that the accused appears in court. “You did not consult the police to arrest the accused person, who failed to appear in court since 17th July, 2023. It is now three months,” she said.  “I order that you pay half of the bail bond.”

The surety had informed the court that she had phoned the accused and told him that his case was coming up on the 17th October, 2023, and he should appear in court. “I in fact phoned him before I came to court but would not pick up my call,” she asserted. “Any time I call him he would not respond.”

The presiding magistrate subsequently adjourned the case until 8th November, 2023, for another surety to show cause why he should not also pay half of the bail bond to the state.
