They were charged on three counts of conspiracy to commit misdemeanor contrary to Section 368 of the Criminal Code, idle and disorderly contrary to Section 166 of the Criminal Code and common nuisance contrary to Section160 of the Criminal Code.
Prosecutors alleged that on the 23rd June, 2024, at London Corner, in the Kanifing Municipality of the Republic of The Gambia, the accused persons conspired within themselves to commit a misdemeanor to wit: idle and disorderly. It was also alleged that they were found at the compound gate of one Peter Gomez, conducting themselves in a manner likely to cause a breach of the peace. They were alleged to have obstructed or caused annoyance to the public.
They all pleaded not guilty when the charge sheet was read to them.
Magistrate Touray, in his judgement, told the court that the prosecution failed to charge the accused persons under the correct sections of the criminal code. As a result, he acquitted and discharged them.
However, he warned the accused persons not to stay at the compound gate of the complainant again, failing which, the law would take its course. He finally discharged them from the dock.
