The motion was tabled by the Minister for Trade, Industry, Regional Integration and Employment (MoTIE), Baboucar Ousmaila Joof during the Second Extra-Ordinary Session of the 2024 Legislative Year.
While tabling the motion the minister the minister explained that the MoU aims to promote recruitment of manpower in a manner that serves the interest of both countries.
“The framework agreement is for at the initial period of one year but may be extended for a period considered appropriate by the signatories if an appraisal of the first year shows that both sides are willing to have an extension,” he said.
However, he noted that “the MoU is not legally binding and therefore, shall not give rights to obligations to either party under any international law.”
He underscored that “workers recruited under this MoU will be issued employment contracts with clearly specified contract durations which compel them to sign up before departure.
“A four year temporary permit shall be issued to successful candidates for this purpose and will be tied to the employment contract.”
“Workers recruited will be required to make formal undertakings to return to their country of origin upon termination or expiry of employment contracts under the agreement,” he added.
“This will help in our collective efforts to combat this menace of irregular migration and mitigate its negative impact.”
He also noted that “there is no financial implication or obligation on the part of the Gambian government in the implementation of this MoU, as the Kingdom’s authorities have expressed their desire to fully fund all activities involving the recruitment process.”
“The MoU seeks to provide a legal pathway for Gambians wishing to seek seasonal employment in the Kingdom of Spain which is in line with government objective of creating employment opportunities for Gambians within and outside the country to reduce unemployment and underemployment.”
“Recruitment of worker will be done through registered and licence private recruitment agencies under the supervision of the department of labour employment management services unit.”
He stated that the MoU was the option as a result of many Gambians embarking on the risky and perilious journey to get to Europe and many more remain willing and ready to do so despite the potentials dangers associated with such journeys.
“In view of the reality addition to the long standing cordial relation between the Kingdom of Spain and the Gambia, the two states recognise the need for closer collaboration in the field of manpower management to promote mutual interest and benefits.”
Hon. Suwaibu Touray, member for Wulli East Constituency, said the government should ensure they manage the remittance recruiters will be sending to the country.
“Many Gambians are outside, and they are sending millions, or if not billions, to The Gambia. How are we managing those remittances? It's a concern” he said.
“Other countries are making very good use of remittances by helping the migrants themselves to organise themselves better, to make sure government invests the money so that even when they come to settle, they'll be able to settle nicely in their homes without much struggle.”
