4 more GALA protesters arraigned

Kemo Fatty, Alieu Bah, Momodou Camara and Omar Saibou Camara were yesterday arraigned before Principal Magistrate Isatou Sallah-M’bai of the Kanifing Magistrates’ Court and charged on two counts of unlawful assembly contrary to Section 63 of the Criminal offences Act, 2025, and common nuisance.

Prosecutors alleged that the accused persons on or about the 15th September, 2025, at the National Audit Office and diverse places in the Kanifing Municipality of the Republic of The Gambia, within the jurisdiction of the Honourable Court, without any lawful excuse, conducted themselves in a manner likely to cause the breach of the peace by holding an unlawful protest against the removal of the Auditor General without a permit from the Inspector General of Police. A similar allegation was made against them on the charge of common nuisance.

They pleaded not guilty when the charge sheet was read to them.

Commissioner A. Sanneh, who represented the IGP along with ASP Yaya Colley, told the court that they were not objecting to bail for the accused persons but attached a disclaimer on the bail condition that the accused should not in the future protest or demonstrate without a permit. “If it happens, their bail should be revoked,” he told the court.

Lawyer Lamin Darboe, representing the accused persons along with Lawyer Junkung Jorbarteh and others, argued that it was the discretion of the court to attach conditions on bail for the accused but not the prosecution.

The presiding magistrate concurred with Lawyer Darboe and granted the accused persons bail in the sum of D50,000 each with one Gambian surety, who should deposit his or her ID card with the registrar of the court.

She further stated that if the accused persons fail to appear in court, the sureties would show cause why they should not forfeit the bail bond to the state. She subsequently adjourned the case until the 21st October, 2025, for hearing of the prosecution witnesses.
