2 arraigned, charged with robbery with violence

A man and a woman were on Thursday arraigned and charged with robbery with violence before Magistrate M. Faal at the Kanifing Magistrates’ Court.

The first accused, Yunusa Joof, and the second accused, Matty Kunta, were charged with robbery with violence contrary to section 273 of the Criminal Code Cap 10:01 Vol: 111 Revised Edition 2009 Laws of The Gambia, and both pleaded not guilty.

According to the particulars of offence, the accused, on 25 September 2023 at Kololi Tavern in the Kanifing Municipality of the Republic of The Gambia, robbed one Abdoulie Bah with a broken bottle and took his simple Techno mobile phone and an amount of One thousand, three hundred dalasis, thereby committed an offence.

The Police prosecutor applied for the matter to be transferred to the Special Criminal Court at the High Court, since it is a capital offence as the court does not have any jurisdiction to try such cases.

He equally applied for the court to deny the accused persons bail and to be kept at the remand for the pending arraignment before the High Court.

The court accepted the application and agreed that the matter be transferred to the High Court and the accused persons be kept at remand for further detention.

According to Section 273 of the Criminal Code of The Gambia, “Any person who commits the felony of robbery is liable to imprisonment for fourteen years. If the offender is armed with any dangerous or offensive weapon or instrument, or is in company with one or more other person or persons, or if, at or immediately before or immediately after the time of robbery, he wounds, beats, strikes, or uses any other personal violence to any person, he is liable to imprisonment for life with or without corporal punishment.”
