Ensa Saidy, a tourist taxi driver, charged with stealing from a motor vehicle, was on 25 August 2014, discharged and acquitted by Magistrate Bojang of the Kanifing Magistrates’ Court.
In delivering his judgement, Magistrate Bojang summarised the evidence of the first and only prosecution witness and that of the accused person.
Citing some authorities, Magistrate Bojang told the court that the prosecution failed to tender a single item which was said to have been stolen, and that it called only one witness.
He said the prosecution failed to prove its case beyond reasonable doubt.
He subsequently discharged and acquitted the accused person, who left the courtroom a free man.
