Sun Beach Hotel case continues

Eliman Manneh, former employee of Sun Beach Hotel, claimed wrongful termination against his former employer at the Kanifing Industrial Tribunal before Magistrate Ngube.

In his testimony, he said that on 6 June 2010, the management brought out a memo that all the staff should take four months’ leave without salary and they accepted it.

He adduced that he applied for leave without salary and the management replied to his application for the four months’ leave without salary.

The plaintiff further stated that his colleagues also applied for four months’ leave without salary.

He said Fatou Sowe, his colleague, authorised him to speak on her behalf, adding that the management asked them to go for another four months’ leave without salary.

He said they refused because they did not apply for it, adding that they reported the matter to the Workers’ Union and Labour Department, who advised the defendant in writing to pay the plaintiffs all their entitlements.

He adduced that the defendant paid them two months’ salary, which he received, without paying other benefits to them.

He said he did not know whether his colleagues received their two months’ salary notice.

Under cross-examination, he added that the defendant extended in writing the four months’ leave without salary to another four months’ but they did not agree, saying he wrote to the defendant to terminate his service and pay him his entitlement.

He further adduced that he worked for the defendant for over six years.

The case was then adjourned till 10 July 2012.
