In delivering his judgement, Chairman Jobarteh told the tribunal that the claim instituted by the plaintiffs against the defendant was for the recovery of the following reliefs: five-month salary arrears amounting to D48,800, interest of 36 per cent and cost.
He said the affidavit of service on a principal officer of the defendant company, one Ousman Saidy, a supervisor, the tribunal invoked Rule 10 of the Industrial Tribunal Rules for the plaintiffs to state their claims.
Jobarteh stated that throughout the presentation of the case of the plaintiffs, the defendant remained absent and was not represented too.
He adduced further that after having perused the evidence of the five witnesses for the plaintiffs, and in the absence of any contra-evidence, the tribunal was satisfied that the plaintiffs had proved their claim before it.
Still delivering the judgement, Chairman Jobarteh posited that the tribunal entered award for the plaintiffs as per their claim.
The defendant shall pay to each of the plaintiffs as follows: Awa Joof, D11,000 for 5 months of salary arrears; Jalika Jarju, D12,600 for 5 months of salary arrears; Haddy Jarju, D12,600 for 5 months of salary arrears and Sainabou Sarjo, D12,600 for 5 months of salary arrears.
Interest of 36 per cent was dismissed.
A sum of D5,000 was awarded to each of the plaintiffs as cost.
Panelists Davies and Cole assisted the chairman of the tribunal.
