Judgment entered in favour of plaintiff

Judgment has been entered in favour of the plaintiff, one Haddy Samba, who sued Lamin Gaye claiming the sum of D120, 000.

Mrs Samba's claim was in respect of money paid to the defendant, Lamin Gaye, for the purpose of buying three compounds from him, which transaction never materialised.

The defendant accepted liability, but told the court that the plaintiff never claimed from him. He stated that he has a plot of land to give the plaintiff, if she would accept, otherwise to give him time to sell the land to pay her.

Following the defendant's admission of liability, the trial magistrate entered judgement in favour of the plaintiff. She again ordered the defendant to pay the plaintiff’s claim of D120, 000 or give her, his land ownership title.

The case was presided over by Magistrate Drammeh of the Kanifing Magistrates' Court.
