Gambia National Lottery motion dismissed

Magistrate Tabally of the Kanifing Magistrates’ Court on 26 March 2014 dismissed a motion for a stay of execution filed by Gambia National Lottery.

According to the motion for a stay of execution, the judgement of the Kanifing Magistrates’ Court dated 25 September 2013, be stayed pending the hearing and determination of the applicants’ appeal filed before the High Court.

The applicants prayed for the court to set aside the said judgement dated 25 September 2013, and to order a hearing between the parties on the merits, and any other orders the court deemed appropriate under the circumstances of the case.

This followed a judgement delivered by Magistrate Tabally in favour of one Alagie Ngum against the Gambia National Lottery in the sum of D942,000 on 25 September 2013.

After the dismissal of the motion for stay of execution filed by the Gambia National Lotter, Magistrate Tabally awarded cost of D5,000 to the respondent, Alagie Ngum.
