Driver in court for causing death

One Modou Bah, a driver was recently arraigned at the Kanifing Magistrates' Court before Magistrate Fatoumatta Drammeh, charged with rash and negligent act causing death.

According to the facts of the case as narrated by CPL 265 Trawally, it happened on 27th September 2005, when a road accident at St. Matty Road involving a commercial motor vehicle, with a registration number BJL2248D driven by the accused, and a cycle pedaled by the deceased, Ebrima Serign Mbowe.

He narrated that according to the accused's own statement, he was coming from Banjul via Mile Seven Road to Bakau and upon arrival at the petrol station he suddenly saw an unknown vehicle coming from the juncture and as he threw his steering wheel he eventually collided with the cyclist.

He said the mobile traffic were informed and the scene was visited by the then CPL 269 Sanyang. He added that the victim was taken to Bakau Health Centre and later referred to the RVTH.

CPL Trawally further informed the court that, they later received a telephone call from the RVTH that the victim had passed away. He said a postmortem was conducted and a certificate was issued to that effect.

Subsequently, the accused was remanded in custody.

The case was adjourned to 15th March 2010 for judgment.
