Court awards over D900, 000 to Access Bank

Senior Magistrate Abdoulie Mbacke of the Kanifing Magistrates' Court on 5th February 2010 awarded D958, 263.63 to Access Bank, after the bank filed three civil suits against three of its customers.

The particulars of claim of the first suit stated that one Yorro Bah was given the sum of D760, 871.57, being money payable by him to the plaintiff, as at 16th November 2009, as a loan which was guaranteed by one Bunama Njie, the second defendant.

The first defendant, Yorro Bah, accepted liability and was ordered to pay to the plaintiff the sum of D761, 371. 57 which includes cost plus interest at the rate of 25% per annum from 16th November, 2009, until the whole judgment sum is liquidated within 21 days. The second dependant, Bunama Njie, denied liability.

The plaintiff's claim in the second suit against ML Suppliers, the defendant, is the sum of D77, 669. 96, being money payable by the defendant to the plaintiff as at 16th November 2009, for money lent by the plaintiff to the defendant. Interest of 25% and cost were also claimed. The defendant accepted liability.

The court ordered the defendant to pay the plaintiff the sum of D78, 169.96 which includes cost and interest at the rate of 25% per annum from 16th November 2009, until the whole judgment sum is liquidated within 21 days.

Another suit filed against one Musa Gaye was for the recovery of D118, 222.10, being money payable by the defendant to the plaintiff as at 16th November 2009, for money lent by the plaintiff to the defendant, which included cost and 25% interest. The defendant accepted liability.

According to Magistrate Mbacke, the court was obliged to give judgment in favour of the plaintiff the sum of D118, 222.10 plus cost of D500 and interest at the rate of 25% per annum from 16th November, 2009, until the debt is completely liquidated.
