Magistrate orders for bench warrant for arrest of accused

Magistrate Don Njie of the Kanifing Magistrates’ Court yesterday ordered for a bench warrant to be issued to one Biran Mbaye for his arrest for failing to appear in court on three occasions.

Mr. Mbaye was earlier arraigned before the court for allegedly biting one Fatou Keita on her forehead.

It was Sub-Inspector Barrow who had applied for a bench warrant to be issued to the accused for his arrest. He also applied for the bail of the accused to be revoked, which was granted by the presiding magistrate. He further stated that the accused only appeared when he took his plea of not guilty. “He never came back to court after he was granted bail. Your Worship, my witness is present in court and the accused is absent. This is the third time he has been absent,” he posited.

In the magistrate’s order, she told the court that a bench warrant should be issued to the accused person for his arrest and that his bail was revoked. She further adduced that when the accused is arrested he should be in police custody or remanded until the determination of the case.

Prosecutors alleged that the accused, Biran Mbaye, on 30 October, 2022, in the Kanifing Municipality of the Republic of The Gambia, bit Fatou Keita on her forehead at Kololi, causing her actual bodily harm.

He was subsequently granted bail with two Gambian sureties who should swear to an affidavit of means and deposit their ID cards with the registrar of the court.

The matter was adjourned to the 6th February, 2023, for continuation of the case.
