Court remands 2 over attempted armed robbery

Two men were on the 21st February, 2024, paraded before Magistrate Colley of the Kanifing Magistrates’ Court and charged on four counts of conspiracy to commit a felony contrary to Section 368 of the Criminal Code, attempted robbery contrary to Section 274 (2) of the Criminal Code, going armed in public contrary to Section 79 of the Criminal Code and possession of firearm without authority contrary to Section 8 and punishable under Section 25(2) of the Arms and Ammunition Act 2009.

The two accused have all been remanded at Mile 2 – State Central Prison.

It was alleged that Seedy Faye and Cyril David Blell on or about the 15th January, 2024, at Fajara, in the Kanifing Municipality of the Republic of The Gambia, conspired between themselves therein wit: going armed in public, robbery with violence and possession of firearm (pistol) without authority.

According to prosecutors, the accused, with a firearm, (pistol) struck with violence and attempted to rob one Ali Seedy with intent to wound him. It was also alleged that they were found with a firearm (pistol) in public without authority.  Prosecutors still alleged that they were found with a pistol without authority and licence.

They pleaded not guilty on all the counts.

ASP Touray, who represented the IGP, applied under Section 62 of the CPC for the court to transfer the case to the Special Criminal Division at the High Court. He further stated that the second count with which the accused were charged is punishable with life imprisonment. He urged the court to remand the accused at Mile 2 Prison by virtue of Section 208A of the CPC until the hearing of the case at the Special Criminal Division at the High Court.

His application was granted.
