Man jailed for 18-months

The Kanifing Magistrates' Court, presided over by Magistrate Drammeh, on 15th March 2010 convicted and sentenced one Modou Bah to 18-months in prison for rash and negligent act causing death.

The facts of the case revealed that on 27th September 2005, in Bakau, whilst driving a commercial vehicle with a registration number BJL 2248D, rashly and negligently caused the death of Ebrima Serign Mbowe by knocking him down, thereby caused his death.

In his plea of mitigation, Assan Martin, the counsel for the convict urged the court to temper justice with mercy, arguing that the convict is the breadwinner of their family.

According to Lawyer Martin, a custodial sentence on the convict means a custodial sentence on the family.

He pleaded to the court that the convict is a young man and was remorseful of his action. He said it was a traffic accident and that the convict had no intention to harm anybody, neither to cause death.
