Man claims D10, 175, 00 in court

Ibianga Agiri, the plaintiff has dragged Alex Braimoh, the defendant to court claiming the sum of D10, 175, 00, being an amount paid by the plaintiff to the defendant in respect of procuring a visa for him which he failed.

Testifying before Magistrate Secka of the Kanifing Magistrates' Court, the plaintiff Ibianga Agiri, told the court that he is a footballer by profession, and that he knows the defendant.

He stated that the defendant informed him that he has an agent in Moscow (Russia) that can aid footballers to travel to Russia for trial.

According to him, upon hearing that he also told the defendant that he was interested in it.

The plaintiff further adduced that he was asked by the defendant to pay some money to start the process soonest. He said he paid D3, 050 and D600 for registration fee and ID card, respectively. He adduced that the defendant had never issued the said ID card to him.

The plaintiff narrated that the defendant further demanded D300 from him to pay for CV, which he paid. He revealed that two weeks later, the defendant called him to his residence and saw him an invitation. Subsequently, he said they made an arrangement to travel to Dakar. He adduced that he also made a payment of $175 for visa fee.

"At Dakar, the defendant went with the documents to his office to pay the visa fee, but he did not show him a receipt," he asserted.

The plaintiff further disclosed that the defendant gave him back his passport, adding that he was told by the embassy to come back in two weeks time.

He finally revealed that the defendant promised him that if he was refused visa, he would pay him back his money. He finally adduced that after several weeks no visa was issued to him, and his money was never refunded to him by the defendant.

The case was adjourned to 8th September 2010 for continuation.
