Assault Case Fails to Proceed

The trial of Kembo Saho of Farato village who has been standing trial of alleged assault causing bodily harm on Monday 22ndDecember 2008 appeared at the Brikama Magistrates' Court presided over Magistrate Kayode.

However the case that was set for the accused to produce his witness could not proceed as the defence witness failed to appear.

According to the CPL 1269 Colley, since the accused Kemo Saho still cannot produce any witness for his defence, the court should close his defence.

In his ruling, Magistrate Kayode told the court that the case cannot be close because the accused's counsel was not in court.

The case was adjourned to 30thDecember 2008.

It could be recalled that the accused Kemo Saho in 2006 at Farato village unlawfully assaulted one Samba an Ex-Imam of Farato by stabbing him with an animal horn all over his body thereby causing him actually bodily harm.
