Lady Njaimeh Jawara, Two Others' Land Case Continues

africa » gambia
Friday, May 30, 2008

The land case involving Lady Njaimeh Jawara, Alhagie Wandifa Jawara and Abdou Magid continued yesterday at the Banjul High Court before Justice Haddy Roche.

Lady Njaimeh Jawara and her two co-defendants are being sued by one Lasana Sillah in respect of a transaction entered into with Lady Njaimeh concerning land situated at Brikama Nema.

Testifying, the 3nd defendant, Abdou Magid, told the court that before he bought the land, he had asked Lady Njaimeh whether she had documents for the said land and she replied in the affirmative.  " I went to the Lands Office in Brikama where I confirmed Lady Njaimeh Jawara 's name in the book," he revealed. " I made enquiry about the land and I was assured that there was no problem about the land. We agreed on the cost of D340, 000, which I paid in cash to Lady Njaimeh Jawara and I was issued with a receipt to that effect," he added.

Further testifying, Mr Magid told the court that he asked Lady Njaimeh about which papers she had, and she said she had the Lease documents. " I was not aware of any dispute in relation to the said land before I paid for it," he adduced. He informed the court that a deed of assignment was executed between him and Lady Njaimeh Jawara. "I paid the Capital Gains Tax and was issued with the income tax clearance certificate under the name of Lady Njaimeh Jawara," he added. "I also paid the stamp duty and I was issued with a receipt," he disclosed, adding that a ministerial consent of transfer was also obtained.

Hearing continues.
