The accused
persons walked out of the court room as freemen following an application made
by the defence counsel Lawyer Assan Martin on the ground the prosecution had
not prepared to prosecute their case.
According to Lawyer A. Martins, it was unfair to hold the accused persons since October, 2008 without prosecution, adding that the accused persons are family members.
In discharging the accused persons, Principal Magistrate Edrissa Mbai posited that the case suffered as a result of lack of diligent prosecution. He therefore struck out the case and discharged the accused persons accordingly.
