Surety in Trouble for Signing Bail Bond

africa » gambia
Wednesday, March 04, 2009

Cadet Inspector Mballow on the 24th February 2009, applied before Acting Principal Magistrate Sainabou Wadda-Ceesay of the Kanifing Magistrate's Court for one Mr Tabally to show cause why he should not forfeit a bail bond of D5,000 to the state. According to prosecutor Mballow, Mr Tabally stood as a surety for one Mariatou Bah who was charged along with one Ousman Jarjue with forgery.

Prosecutor Mballow went on to state that since the accused, Mariatou Bah, had absconded, it was the surety who bound him self to produce the accused anytime for trial. He adduced that the police are unable to execute a bench warrant because the accused is at large.

The surety, Mr Tabally, asked the court whether it could reduce the D5,000 bail bond for him to pay. He noted that he does not know the accused and that there was a co-trader who approached him to bail the accused who gave him the impression that she was taking her child to Foni for treatment.

The case was adjourned to 10th March 2009.
