Prosecution withdraws case

Sergeant 1781 Kinteh, on 7 December 2011, withdrew a case against one Assan Dundeh and Assan Sanyang, who were charged with willful damage to property, an allegation they earlier denied.

Making his application before Magistrate Ngube of the Kanifing Magistrates’ Court, prosecutor Kinteh said he was withdrawing the case under Section 68 (1) of the CPC.

He told the court that the complainant was not serious with the case because he had never appeared in court to testify against the accused persons.

It was not fair to keep the accused persons in custody at Mile Two Central Prison while the complainant had not shown interest in the case.

As a result, Magistrate Ngube granted the application and discharged the accused persons, who walked out of the court after regaining their liberty.

The particulars of offence of the charge sheet stated that the accused persons on 11 September 2011, at Serrekunda, in the Kanifing Municipality, willfully damaged the windscreen of the complainant’s vehicle valued at D2,600, the property of one Gorra Ngum and thereby committed an offence.
