GTA, Others Civil Suit Resumes

The prolonged civil suit filed by one Momodou B. Janneh against Sparan Limited, Gambia Tourism Authority, Secretary of State for Land and the Attorney General Chambers resumed on Monday 23rd March 2009 at the Brikama High Court.

When the matter was called, it could not proceed into a full trial due to the fact that the second defendant, GTA, was absent from court. The presiding Judge, Justice Ngui-Mboob-Janneh also told the court that the defence counsel had written a letter for an adjournment of the case. The case was adjourned to the 30th March 2009 for hearing.

The suit is for a court declaration that the plaintiff is the owner or person entitled to possession of all that piece or parcel of land in legal tussle situated at Tujereng instead of Sparan Limited, the first defendant.

And to the court to issue an injunction restraining Sparan Limited and GTA, their agent employee and all other persons acting or their behalf in any capacity of whatever description from entering the contested land, or interfering with the plaintiff's right of possession or occupation thereof, or alienating in anyway or doing anything inconsistent with the plaintiff's right or title thereto.

As well as claiming damages for trespass from the first and second defendants, and eviction of Sparan limited, the Plaintiff also claimed cost.
