Court enters judgment in favour of Ecobank

The Kanifing Magistrates' Court on the 9th July 2010 entered judgment in favour of Ecobank, following summons filed by lawyer Badou S.M. Conteh on behalf of the plaintiff against its customers, who owed the bank money.

Magistrate Drammeh, who presided over the case, delivered judgment in favour of the plaintiff, Ecobank, based on the particulars of claims against the bank's customers namely, Abdourahman Camara, American General Trading, Amadou Darboe, Fanny Therese Gomez, Bai Ibrahim Cham, Adama Yusupha Corr and Bai Saikou Jaw.

According to the particulars of claim against Abdourahman Camara, he owes Ecobank the sum of D28, 353.74 being money payable by the defendant to the plaintiff as at 23rd February 2010. Interest of 22% per annum on the said sum from the 23rd February 2010 until payment was made to the bank. The trial Magistrate awarded D2, 000 to the plaintiff as cost.

American General Trading is facing a claim of D583, 143.23 from the bank payable by the defendant to the plaintiff as at 5th May 2010, with 30% interest on the sum until payment. Ecobank was also awarded D6, 000 as cost by the court.

The sum of D43, 547.26 was claimed by the bank against Amadou Darboe payable as at 23rd February, 2010 which attracted an interest of 22% per annum on the said sum from the 23rd February, 2010, until payment. The court also awarded D2, 500 to the bank as cost.

Ecobank claimed the sum of D24, 359.85 against Fanny Therese Gomez which she owes and was payable as at 23rd February 2010. Interest at the rate of 22% on the sum was also claimed by the bank. The court awarded the bank D2, 000 as cost.

The bank would not relent to claim D123, 395.95 against Bai Ibrahim Cham payable as at 23rd February, 2010 with 22% interest on the said sum until payment. Another cost of D6, 000 was awarded to the bank by the court.

Amada Yusupha Corr also faced Ecobank's claim of D80, 651.19 against him payable as at 23rd February 2010, with 22% interest per annum on the sum until payment. This attracted a cost of D6, 000 awarded to the plaintiff by the court.

The bank further claimed that Bai Saikou Jaw borrowed the sum of D31, 595.64 payable as at 23rd February, 2010, which he failed to pay. The plaintiff also claimed 22% interest on the sum until payment. The court used its discretion, and awarded D3, 000 to the plaintiff as cost.
