A 64-year-old British national, Edwin Arthur Levender, and his Gambian partner, Jalikatou Bah, 27, were on 18th January 2010 arraigned before magistrate Olajibutu Kayode of the Bundung Magistrates' Court, charged with indecent exposure.
According to the particulars of the offence, on 17th November 2009, at
Testifying for the prosecution, one Kawsu Suwareh told the court that he is a businessman at the beach side, and could recognise the accused persons.
According to him, on 17th November 2009, while he was at the beach side, he saw the two accused persons in between the two restaurants, and that he saw the first accused taking the photograph of the second accused with his camera, who was at the time naked.
He further told the court that he approached the first accused, and asked if he would do such in his home country. At that juncture, the second accused intervened by remarking: "He is my husband," testified Mr. Suwareh.
He added that the accused persons then started insulting him, and as a result, people started coming from different directions.
He told the court that he managed to snatch the camera from the first accused person (Edwin Arthur Levender) and ran with it to the TDA security post, where he handed it over to the soldiers there.
He said the soldiers later visited the scene, and arrested the accused persons.
The camera was tendered in court as an exhibit.
