Alleged homosexuals deny any wrongdoing

Three Gambians alleged to have been engaged in homosexual acts in the country and diverse places yesterday appeared at the High Court in Banjul before Justice Abi.

The three suspects - Alieu Sarr, Momarr Sowe and Modou Lamin Bittaye - were charged with six counts of unnatural offences and conspiracy, which they all denied.

Counsel LS Camara, S. Jahateh and Coker represented Alieu Sarr and Momarr Sowe, while BS Touray represented Modou Lamin Bittaye.

The particulars of offence in count one stated that Alieu Sarr, sometime in 2010 at Bijilo in the West Coast Region, committed an offence when he engaged in homosexual acts with Fallou Camara.

Count two stated that Alieu Sarr on the same date, place and time, engaged in homosexual acts with Serign Boye Jallow.

Count three stated that Alieu Sarr sometime in 2014 at Brusubi in the West Coast Region, conspired with Fallou Camara to engage in homosexual acts.

Count four stated that Alieu Sarr, in the same place and time, conspired with Serign Boye Jallow to engage in homosexual acts.

Count five stated that Alieu Sarr, in 2002 at diverse places in The Gambia and elsewhere, conspired with Momarr to engage in homosexual acts.

Count six stated that Alieu Sarr in 2013 at diverse places in The Gambia and elsewhere, conspired with Serign Mboob to engage in homosexual acts.

Modou Lamin Bittaye

The particulars of offence in count one stated that Modou Lamin Bittaye sometime in 2014, at Kotu in KMC, engaged in homosexual acts with Saloum Njie.

Count two stated that Modou Lamin Bittaye sometime in 2014, at Busumbala in the West Coast Region, engaged in homosexual acts with Njanko Ceesay.

Count three stated that Modou Lamin Bittaye, in 2014 at Latrikunda in the KMC, engaged in homosexual acts with Gibou Jatta.

Count four stated that Modou Lamin Bittaye, in 2014 in Busumbala, conspired with Njanko Ceesay to engage in homosexuality.

Count five stated that Modou Lamin Bittaye, in 2014 in Latrikunda in the KMC conspired with Gibou Jatta to engage in homosexual acts.

Momarr Sowe

The particulars of offence in count one stated that Momarr Sowe, sometime in 2002, at Brusubi in the West Coast region, conspired with Modou Lamin Conateh to engage in homosexual acts.

Count two stated that Momarr Sowe, at Brusubi in the West Coast Region, conspired with Modou Lamin Conateh to engage in homosexual acts.

Count three stated that Momarr Sowe, sometime in 2003 at Lugis Restaurant in Palma KMC and elsewhere, conspired with Kebba Ceesay to engage in homosexual acts.

Count four stated that Momarr Sowe, in 2003 at diverse places in The Gambia and elsewhere, conspired with Iker Nyan to engage in homosexuals acts.

The defence counsel, LS Camara, said he and his team have filed an application for bail on behalf of their clients, Alieu Sarr and Momarr Sowe, which was pending before the court since 28 January 2015.

The state represented by AM Yusuph said they have responded to the application since 5 February 2015.

BS Touray, counsel for Modou Lamin Bittaye, said bail for his client was more urgent than the hearing of the matter.

The trial judge, Justice Abi, then adjourned ruling on the bail application until 12 February 2015.

The judge also adjourned the case of Alieu Sarr and Momarr Sowe until 16 February 2015, for hearing.
