Social Security and Housing Finance Corporation (SSHFC) is currently embroiled in a legal litigation with Julakay Engineering and Construction Company over arrears of D85, 000.00 concerning social security contributions and statutory penalty levied thereon from April 2004 to June 2005.
The particulars of claim state that the plaintiff (SSHFC) is a statutory corporation, established under the Social Security and Housing Finance Act (cap 52) and responsible for administering the National Provident Fund as constituted by the said Act.
SSHFC is claiming that the defendant (Julakay Engineering and Construction Company) is under an obligation under the Act to contribute 15 percent of each its employee's salary to the National Provident Fund as such employee's social security contributions.
The claim indicates the Act imposes a penalty of five percent on any unpaid contribution.
According to the plaintiff, between April 2004 and June 2005, the defendant failed to forward the contributions of its employees as provided by the Act.
The claim further indicates that by a letter dated 28th December 2005 the plaintiff after repeated demands caused its solicitor to write to the defendant to settle the sum of D85, 320.08 as arrears of contribution and statutory penalty as at June 2005, but the defendant has neglected or refused to settle the said some.
