Woman gets heavy fine for false publication

Magistrate Joof of the Kanifing Magistrates’ Court recently convicted and sentenced one Fatou Manneh on count one to a fine of D10,000, in default to serve one year in prison, and on count two also to a fine of D10,000, in default to serve another one year in prison.

Fatou Manneh, who was convicted on charges of false publication and broadcasting, was also ordered to pay a compensation of D50,000 to the complainant, in default to serve one year in prison.

This was after her plea of guilt to two counts of criminal libel and false publication and broadcasting.

Narrating the facts of the case, police Supretendant Jarju, stated that, the accused has a husband who lives in Holland.

He said sometime in August 2017, the husband sent her pictures of the complainant, Nanding Marong, threatening her that he was going to divorce her, in order to marry the complainant.

Out of this, he narrated, the accused, Fatou Manneh, used two pictures of the complainant with one naked picture of a woman with an audio and threatening word, before posting it to social media whatsapp.

Therein, the complainant received a phone call from her friend, Aja Jawneh, who informed her to go to the internet, which the complainant did, and she saw the said pictures; one bearing her in the middle of the two sent by the accused with an audio “you are following my husband and I will expose you to the whole word.”

He narrated that the complainant reported the matter to Kotu Police Station and the accused was subsequently arrested.

He said during an investigation they found out that the picture of the complainant was sent to the accused by her husband, who did not even know the complainant, but he just wanted to frustrate her with a picture of the said naked woman.

It was false information and the accused was cautioned and charged, he narrated.

The charge sheet on count one stated that sometime in August 2017, at Kottu and diverse places, in the Kanifing Municipality, the accused, Fatou Manneh, willfully and unlawfully published two pictures of one Nanding Marong and another picture of a naked girl attached, with intent to expose her to hatred or injure her reputation.

Count two read that, she without lawful excuse or authority shared two pictures of one Nanding Marong, the complainant, attached with a naked picture of a girl purportedly to be her, knowing or having reason to believe that the said publication was false and knew to be false at the time.
