Court orders State to file appeal within 30 days

Justice Ebrima Jaiteh of the High Court in Banjul has ordered the State to file their petition and grounds of appeal within 30 days before The Gambia Court of Appeal in the matter of the State vs Alhagie Camara.

Alhagie Camara was acquitted and discharged by Justice Ebrima Jaiteh, but following the court’s decision, State Counsel E. Jaiteh informed the court of the State’s intention to appeal the decision pursuant to Section 285(E) (4) of the Criminal Procedure Code.

Following the State counsel’s notice of appeal, the presiding judge ordered that the Alhagie Camara be detained at Mile Two Central Prison pending the hearing and determination at The Gambia Court of Appeal.

Justice Jaiteh further ordered that pursuant to Section 285 (E) (4) of the Criminal Procedure Code, the order to detain the accused shall be deemed to be quashed if the prosecution fails to file their petition and grounds of appeal within 30 days from 3 June, 2019.
