Court orders installment payment

One Mikel George, the judgement creditor has dragged Malick Dibba to court after he fails to pay an outstanding balance of D78, 089, since judgement was entered in his favour for three years now.

The judgement creditor, Mikel George told the court that he knows the debtor, Malick Dibba, whom the court had ordered to pay him.

According to him, it was in January 2010, when he collected D10, 000 from him leaving an outstanding balance of D78, 089, which he now wants the court to order him to pay.

He revealed that the debtor has all the means to pay him, but he refused. He stated that he had not been working for three years, and that life has become very difficult for him.

The debtor, Malick Dibba, for his part, told the court that he is making payment plan to settle the outstanding balance, and asked the court to give him time to settle the debt.

The magistrate, in his ruling, stated that she heard from both parties. She said the debt has been outstanding for three years.

She finally ordered the debtor to make an installment payment of D10, 000 on or before the 30th of April 2010 and D5, 000, at the 30th of each subsequent month.

She ruled that in default of any monthly installment payment, the whole sum would be due immediately.

The case was presided over by Magistrate Drammeh of the Kanifing Magistrates' Court.
