Court Acquits Accused, As Prosecution Fails to Prove Case

The Kanifing Magistrates' Court yesterday acquitted and discharged one Julaba Njie.

Mr. Njie, a Premium Security Officer, was charged with stealing 30 pieces of aluminium profiles valued at D38, 200.

Mr. Njie has resolutely denied the charge.

In his judgement, Magistrate Mahoney told the court that the prosecution's evidence was circumstantial. He stated that the accused only introduced the seller of the aluminium profiles in question to the buyer. He said initially the accused was charged with stealing 30 pieces of aluminium profiles and the number was later changed to 20.

He noted that the testimonies of the prosecution's witnesses were not consistent and did not corroborate each other.

He added that the prosecution had failed to prove the case beyond reasonable doubt.

The charge sheet alleged that Mr. Njie sometime around November and December 2007, at West Field, stole from Gam-tech Construction Company 30 pieces of aluminium profiles valued at D38, 000.

The accused was granted a court bail in the sum of D80, 000.
