Africell drags MGI Telecoms Ltd to court for $1M

Africell Gambia Ltd’s civil suit against MGI Telecoms Ltd. proceeded yesterday, 15 February, 2018, before Justice Ebrima Jaiteh of High Court in Banjul.

Africell Gambia is claiming among others, the sum of one million dollars being damages for interference with contractual relations, namely a consortium agreement made on the 16 September, 2011, between Africell, Comium Gambia Ltd., Netpage Company, Qcell Company Ltd., Unique Solutions Company Ltd., Gambia Telecommunication Company Ltd., Gambia Telecommunication Cellular Company Ltd., The Government of the Republic of The Gambia, The Gambia Submarine Cable Trust and The Gambia Submarine Cable Company Ltd.

An injunction to restrain the defendant( MGI Telecoms Ltd.) by themselves, their servants or agents, howsoever, from interfering in any way with the property and/or business of the plaintiff and to prevent them from committing a repetition thereof, inducing or procuring breaches of or unlawfully interfering with the plaintiffs rights under the consortium agreement dated 16 September, 2011, between Africell Gambia Ltd., Comium Gambia Ltd., Netpage Company Ltd., Qcell Company Ltd., Unique Solutions Company Ltd., Gambia Telecommunications Company Ltd., Gambia Telecommunications Cellular Company Ltd., The Government of the Republic of the Gambia, the Gambia Submarine Cable Trust and the Gambia Submarine Cable Company Ltd.

The case was set for hearing of the motion but during yesterday’s sitting, plaintiff’s lead counsel, Ida Drammeh informed the court that the plaintiff have filed an affidavit in reply and had served the defendant.

Lawyer Hawa Sisay-Sabally who acknowledged receipt of the affidavit in reply craved the court’s indulgence to give her a little time to study the documents and to react if necessary.

The matter was then adjourned to 20 February, 2018, for ordering of briefs.
