10th witness continues cross examination in NIA 9 trial

The defence team led by lawyer C.E. Mene, yesterday, Feb. 12, 2018 continued cross examination of Pa Serign Mboob, the 10th prosecution witness in the criminal case involving the state against nine former officials of the defunct NIA before Justice Kumba Sillah –Camara at the High Court in Banjul.

The accused persons; Yankuba Badjie, Louie Richard Leese Gomez, Saihou Omar Jeng, Babucarr Sallah, Yusupha Jammeh, Haruna Susso, Tamba Mansary, Lamin Darboe and Lamin Lang Sanyang are charged with 26 counts including conspiracy to murder, murder, assault causing grievous bodily harm, abduction, making false documents without proper authority amongst others.

The witness told the court that he joined the NIA in July 2015 and he served in the Drug Squad before joining the NIA in 2015.

The witness disclosed that he left the Drug Squad because he was not happy with the way he was treated but Defence Counsel Mene alleged he was dismissed because of his misconduct in a drug case he was involved in.

The witness told the court that in his evidence in chief, he testified that he heard Noghoi Njie said in Mandinka Language that she should be allowed to tie her wrapper.

The witness said at the time she was not wearing a wrapper, adding that he didn’t see her with underwear and a top on.

The witness further said that he saw Tamba Mansary took out a black object from his back pocket and as he wanted to kick Noghoi Njie, he fell down.

Asked if at the NIA, officials are allowed to carry black object around to which he replied it is not permissible for any NIA agent to carry object to beat or torture suspects.

The witness told the court that when he saw Noghoi Njie, he ran to the interview hall and sat down.

Pa Serign Mboob testified that the interview hall was few metres away from where he saw Noghoi Njie, adding that he ran away because she is a woman and was naked.

The witness further testified that they started interviewing the suspects at about 8:00 p.m. and Noghoi Njie was the first suspect that was interviewed and was dressed up during the interview.

The witness disclosed that he was not aware whether Solo Sandeng was the fourth suspect that was interviewed but that at some point Babucarr Sallah, Tamba Mansary and Lamin Darboe was tied up at the conference hall entrance door.

The witness further disclosed that the camera was set up inside the hall during the interview, adding that the camera was far and the panelists were sitting closer to the door.

Pa Serign Mboob told the court that Kebba Secka, the 9th prosecution witness sat in the same row with him but sat at the end of the row, noting that each of them sat in a single chair and not on a long bench.

The witness said he cannot remember the interval for interviewing each suspects and cannot remember how many suspects he interviewed after Solo Sandeng.

The witness further said he made a statement at the Police Headquarters which he identified and was tendered in evidence as defence exhibit.

Pa Serign Mboob told the court that he was aware that the entire interview at the conference hall was recorded, noting that the interview ended at about 1:00 a.m.

The witness maintained that all he told the court was the whole truth and nothing but the truth.
