10 alleged Farato protesters face 11 charges

The High Court in Banjul on Monday began the trial of 10 accused persons facing 11 criminal charges in connection with violence that erupted at Farato village, Kombo South District of the West Coast Region on 23 May 2017.

The accused persons: Alhagie Dulo M.H. Sambou, Kebbah Drammeh, Alhagie Imam Ousman Ceesay, Alhagie Jobe, Alieu Touray, Bakary Manneh, Alieu Faal Junior, Sainey Bayo, Alieu Faal and Ebrima Secka, earlier faced criminal charges at the lower court in Brikama, only to be transferred to the High Court for lack of jurisdiction of the lower court to hear the matter.

On count 1, they are all charged with incitement to violence, by allegedly chanting abusive slogans and pelting missiles on government officials, leading to the destruction or damage of properties.

On count 2, the accused persons are charged with unlawful assembly, by alleging to have assembled with intent to cause destruction and obstruction of government officials from carrying out their duties.

On count 3, they are charged with riot, by alleging that all the accused persons riotously assembled and caused breach of peace and terror to the public by chanting, pelting missiles and obstruction of government officials from carrying out their duties.

On count 4, they are charged with riots and destroying machinery, by alleging that the accused persons riotously assembled together and unlawfully damaged a bulldozer.

On count 5, they are all charged with malicious injuries, by alleging that they have willfully and unlawfully destroyed a bulldozer by setting fire to it.

On count 6, they are also charged with malicious injuries to properties, by alleging that all the accused persons willfully and unlawfully destroyed a Mercedes Benz car belonging to one Sarja Gibba, by setting the car on fire.

On count 7, the accused persons are charged with malicious injury to property and they were alleged to have in May at Farato willfully and unlawfully destroyed sets of furniture, by setting them on fire.

On count 8, they are charged with assault, as they were alleged to have assaulted police officers who were duly executing their duties.

On count 9, they were alleged to have conspired to commit a misdemeanor, that all the accused persons committed an offence to wit: conspired to riotously assemble.

On count 10, they are charged with conspiracy to commit felony, and they were alleged to have conspired to unlawfully damage a bulldozer engaged in a demolition exercise, by setting the bulldozer it on fire.

On count 11, they are charged with conspiracy to commit felony, and they were alleged to have conspired to unlawfully destroy a Mercedes Benz car belonging to Sarja Gibba, by setting fire to it.
